Terms and Conditions

Terms and conditions for the use of our website and the purchase of products through our event booking and management platform EventWiz and ticketing platform partners.

Please Read Before Using Our Website or Purchasing Tickets

These terms and conditions govern the use of our website and the purchase of products through EventWiz and our ticketing platform partners (Sum-up / Wix / TicketFlex and Beyonk). With our tickets, Booking Fees will be shown if they are applied.

Our events are delivered by either Montserrat Events CIC for all community driven events, while all ticketed and corporate events will be delivered by Montserrat Events and Festivals Limited.

General Terms

If you have any queries about these terms, please contact us using the contact form. The terms and conditions herein together with any notices or conditions on other areas of this website will all together govern use by customers of this website.

For each event there may be specific conditions; these will be advised per event.

You should note that Montserrat may at any time make changes to or remove part of this website without any liability to customers for such changes.

Montserrat reserves the right to change these terms and conditions in the future without specifically notifying customers, and continued use of the website or placing of orders after such changes shall be deemed to be acknowledgement and acceptance thereof.

Placement of an Order

A contract will only come into existence between you the customer and us once your order has been processed and dispatched.

When you as a customer place an order via this website, you warrant by placing the order that:

You are not a minor or otherwise legally incapable of entering into a binding contract.
The personal details which you give us on registration are fully complete and accurate.
You are not using a false name or the name of any other person or body which you are not authorised to use.
Montserrat are VAT registered where all costs / fees / ticket prices will have VAT charged where applicable - this may be shown as an inclusive or exclusive figure.

When you place your order you are doing so in acceptance of these terms and conditions and it is important that you have read them before you go ahead and order.

Cancelling

Cancelling a Stall Order

As a customer, when placing this order you are therefore booking for a pitch at the given event; you must be sure to have the date free from any other bookings. Once you have booked there are no refunds available unless the organisers cancel the event.

Cancellations Policy Regarding Tickets

The Organisers reserve the right in exceptional circumstances beyond our control to cancel or amend the event without notice; in which case no refunds will be given to public, traders or any other person/persons affected by any change or cancellation.
The tickets are non-refundable.
Tickets are not transferable and may not be resold.
Please note that booking fees are non-refundable.
The Organisers of this event accept no liability for any loss by any person/persons on or around the event areas. Public liability insurance will be in place.

Acceptance of an Order

When an order is placed you will get an order confirmation sent to the email address you provided during checkout. Following this you will need to provide the necessary paperwork including Full Risk Assessment and Public Liability Insurance. These will be requested by the event Health and Safety Leader.

Delivery

The event arrival information (Location / Carparking / Times) will be provided to your email address at least 1 week before the event date.

Liability

We try to have the information on this website as accurate as possible but we make no warranties, whether express or implied, regarding its accuracy. We also do not make any warranties regarding any matters relating to the use of this website and it is a matter for you to ensure that your own equipment is protected from viruses or other external factors.

Your rights are protected by the Sale of Goods and Supply of Services Act, 1980, and also the Consumer Protection Act, 2007, where you are a consumer. Nothing in this website shall affect your rights under the applicable law.

Severance

If any of these terms and conditions shall prove to be void, unlawful, or unenforceable for any reason then such term or condition shall be deemed to be severed from the remaining terms and conditions which shall remain valid and enforceable.

If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Smile Emporium or Event Pitch Provision

The organisers will be insisting that all stall holders need to have a strong and robust gazebo and a minimum weight of 13kg per leg if they wish to attend. In the event of the stalls being located indoors then the requirement to have a Gazebo will be confirmed. In some cases stalls can be left overnight; this is based on each specific event. The organisers though take no responsibility for any damage or loss to stock, gazebos or equipment left on the event site.

For every event, the organisers actively market and advertise across a wide range of promotional channels to attract strong audiences; however, we will never guarantee footfall, sales, or the weather. We do ask that if you are attending you promote and TAG the event and organisers within your social media posting.

Stall bookings are managed and paid through the Montserrat event platform EventWiz, where vendors will have an account to manage their bookings. Event pitch provision will be booked and invoiced directly.

Pitch allocations will be determined and arranged by the organisers and these are not to be changed without discussions and agreement with and from the organisers.

Food and Drink vendors will need to be required to supply the necessary hygiene paperwork, fire and risk assessments plus adhere to our oil policy.
